Guidelines for Developing a Privacy Notice for Minors in Thailand

The objective of this research is to examine the issues related to the guidelines for developing a privacy notices for minors in Thailand. The findings reveal that personal data protection for minors under Thailand’s Personal Data Protection Act B.E. 2562 (PDPA) lacks clear and practical guidance for delivering privacy notices tailored to minors. This results in operational difficulties for data controllers and hinders minors’ ability to understand and exercise their data rights. Current practices show persistent issues, particularly regarding parental consent and age verification, which weaken the law’s effectiveness in protecting minors. Moreover, most digital platforms and
service providers continue to use a uniform privacy notice for both adults and children without age-specific adaptations. This leads to minors’ limited understanding of data processing activities and increases their vulnerability to data breaches. Therefore, this study proposes the development of practical guidelines for drafting privacy notices that are suitable for minors in Thailand, taking into account differences in age, comprehension levels, and communication channels.
