บทคัดย่อ

Regulation (EU) 2025/40 on Packaging and Packaging Waste หรือ PPWR เป็นกฎหมายที่ใช้บังคับโดยตรงและมุ่งจัดการกับบรรจุภัณฑ์ตลอดวงจรชีวิต ตั้งแต่การออกแบบ การผลิต การวางตลาด การใช้ซ้ำ การรีไซเคิล และการจัดการภายหลังการบริโภค โดยมีข้อกำหนดสำคัญเกี่ยวกับการควบคุมสารอันตรายในบรรจุภัณฑ์ การออกแบบเพื่อการรีไซเคิล การกำหนดสัดส่วนวัสดุรีไซเคิลขั้นต่ำ การลดขนาดและปริมาตรของบรรจุภัณฑ์ การห้ามใช้บรรจุภัณฑ์บางประเภท อีกทั้งยังกำหนดหน้าที่ของผู้ประกอบการไว้อย่างชัดเจนตามบทบาทในห่วงโซ่อุปทานที่เกี่ยวข้องกับบรรจุภัณฑ์เช่น ผู้ผลิตสินค้า ผู้ผลิตบรรจุภัณฑ์ ผู้จัดหาวัสดุบรรจุภัณฑ์ ตลอดจนผู้ประกอบการที่จำหน่ายสินค้าผ่านช่องทางออนไลน์ หากไม่สามารถปฏิบัติให้สอดคล้องกับข้อกำหนดของ PPWR อาจเผชิญความเสี่ยงจากการถูกปฏิเสธสินค้า การระงับการนำเข้า การเรียกคืนสินค้า หรือการสูญเสียความสามารถในการแข่งขันในตลาดสหภาพยุโรป ดังนั้น ผู้ประกอบการไทยที่ผลิตสินค้าและบรรจุภัณฑ์เพื่อส่งออกไปยังสหภาพยุโรปจำเป็นต้องเร่งปรับตัวโดยการออกแบบบรรจุภัณฑ์ให้สอดคล้องกับหลักเศรษฐกิจหมุนเวียน จัดทำเอกสารทางเทคนิค ตรวจสอบข้อมูลจากห่วงโซ่อุปทาน และพัฒนาระบบการปฏิบัติตามกฎหมายเพื่อรองรับมาตรฐานด้านบรรจุภัณฑ์ที่เข้มงวดมากขึ้น
