บทคัดย่อ

ในโลกยุคดิจิทัลปัจจุบัน ปัญญาประดิษฐ์ (Artificial Intelligence) ได้เข้ามามีบทบาทเกือบทุกด้านในชีวิตประจำวันของมนุษย์ ในแง่ของการทำสัญญา ได้มีการเริ่มใช้ปัญญาประดิษฐ์ (Artificial Intelligence) ในการทำสัญญาโดยเริ่มต้นตั้งแต่การทำคำเสนอ และตอบรับด้วยคำสนองโดยอัตโนมัติ สัญญาอัตโนมัติดังกล่าวสามารถก่อให้เกิดผลผูกพันทางกฎหมายธุรกรรมทางอิเล็กทรอนิกส์ อย่างไรก็ดี การใช้สัญญาอัตโนมัติยังคงพบกับความท้าทายในประเด็นเรื่องเจตนาของคู่สัญญาเมื่อเกิดการกระทำที่ไม่คาดหมายได้ (Unexpected Action) บทความนี้มุ่งเน้นศึกษาถึงกฎหมายที่เกี่ยวข้องและแนวทางการบังคับใช้สัญญาอัตโนมัติ (Automated Contract) ภายใต้บริบทกฎหมายของสหภาพยุโรป
