Legal Issues Concerning the Principle of Adverse Possession in Real Property and Land Title Registration in Thailand

Abstract

Adverse possession is when a person possesses another person’s property peacefully, openly, and with the intention of ownership. For immovable property, possession must be continuous for 10 years; for movable property, it must be continuous for 5 years, after which the person gains ownership rights. Acquiring ownership rights in real estate through adverse possession is a legal method of gaining property rights because of the law. There are legal considerations that should be examined to enhance understanding of the legal principles involved in this matter, which are the nature of possession, the period required for acquiring rights, and the relationship between acquiring rights and registration. Even among legal experts, there can be differing opinions on these issues. This article aims to examine the principle of adverse possession within the context of the title registration system, through a comparative analysis of Thai lawand foreign legal systems.
